Terms of Service

By accessing or using Plandeck ("the Service"), you agree to be bound by these Terms of Service. By creating an account or purchasing a subscription, you also explicitly agree to these Terms. If you do not agree, please do not use the Service.

You must be at least 16 years old, or otherwise have legal capacity to enter into a binding contract under the law of your jurisdiction, to use the Service. If you are using the Service on behalf of an organization, you represent that you are authorized to bind that organization to these Terms.

Plandeck is a browser-based planning poker tool that enables agile teams to estimate user stories in real time. The Service is operated by BEASTINCT s.r.o. and is available as a free tier as well as paid subscription tiers (Pro, Team, Enterprise). The Service is provided "as is" and "as available" without warranties of any kind.

Plandeck offers paid subscription plans — Pro, Team, and Enterprise — available on monthly and annual billing cycles. Prices are listed on our pricing page.

• Payment processing: All payments are processed securely by Stripe. We do not store your payment card details.
• Auto-renewal: Subscriptions renew automatically at the end of each billing period. You may cancel at any time from your account settings to prevent future charges.
• Price changes: We will notify you of any price changes at least 30 days in advance via email. Continued use after the change takes effect constitutes acceptance of the new price.
• Failed payments: If a payment fails, we will retry and allow a 24-hour grace period. After this period your account will be downgraded to the free tier until a successful payment is made.
• AI credit packs: AI credit packs are one-time purchases and are non-refundable once consumed.
• Taxes: All displayed prices include applicable taxes where required by law.

If you are a consumer within the European Union, you have the right to withdraw from a purchase contract within 14 days without giving any reason, pursuant to Directive 2011/83/EU and § 1829 of the Czech Civil Code.

To exercise this right, notify us by email at legal@plandeck.app within 14 days of the purchase date, stating your intention to withdraw.

Exception: If you explicitly consent to immediate access to digital content (e.g., by activating a subscription or consuming AI credits), you acknowledge that the right of withdrawal expires upon first use of that digital content.

Where a valid withdrawal is accepted, we will refund the amount paid within 14 days of receiving your withdrawal notice, using the same payment method you used for the original transaction.

You may cancel your subscription at any time via your account settings or by emailing legal@plandeck.app. Upon cancellation, your access to paid features continues until the end of the current billing period.

We do not provide pro-rata refunds for unused portions of a billing period, except where required by applicable law or as described in the Right of Withdrawal section above. AI credit packs are non-refundable once purchased.

You agree not to:

• Use the Service for any unlawful purpose
• Attempt to disrupt or degrade the Service (e.g., denial of service attacks)
• Automate room creation in a way that abuses the free tier
• Impersonate other users or entities
• Transmit malicious code or content through the Service

We reserve the right to terminate access for users who violate these terms.

Plandeck does not require user accounts for participants joining a room — voters and observers can join via a shared link by entering a display name. Only the facilitator who creates a room (or initiates an async voting session, or uses AI features) needs a free Plandeck account. Voter display names are local to each session and are not verified or persistent. You are responsible for the display name you choose.

For free-tier users, room data (votes, player names, topics) is ephemeral: it lives only on the real-time room server for the duration of the session and is discarded when the session ends or after a period of inactivity. It is not written to our long-term database or kept as session history.

Paid-plan users (Pro, Team, Enterprise) benefit from session history — game session data including votes, topics, and estimates is persisted in our database according to the retention periods described in our Privacy Policy.

The Plandeck name, logo, and software are owned by BEASTINCT s.r.o.. Nothing in these terms grants you a license to use our intellectual property except as required to use the Service.

The Service is provided "as is" without any warranty, express or implied, including warranties of merchantability, fitness for a particular purpose, or non-infringement. We do not warrant that the Service will be uninterrupted, error-free, or secure.

To the fullest extent permitted by law, BEASTINCT s.r.o. shall not be liable for any indirect, incidental, special, or consequential damages arising from your use of the Service, even if we have been advised of the possibility of such damages.

In any case, our total aggregate liability shall not exceed the amount you have paid us in the 12 months preceding the claim.

If you have a complaint about the Service, please contact us at legal@plandeck.app. We will endeavor to respond within 30 days.

If you are a consumer and we are unable to resolve your complaint, you may contact the Czech Trade Inspection Authority (Česká obchodní inspekce, ČOI) at www.coi.cz.

You may also use the European Commission's Online Dispute Resolution (ODR) platform at ec.europa.eu/consumers/odr.

These Terms are governed by and construed in accordance with the laws of the Czech Republic. Any disputes arising under these Terms shall be subject to the exclusive jurisdiction of the competent courts of the Czech Republic.

If you are a consumer, nothing in these Terms affects your rights under the mandatory consumer protection laws of your country of residence.

We may modify these Terms at any time. Continued use of the Service after changes constitutes acceptance of the updated Terms. Material changes will be announced on our blog.
